ITPA Legislative Update

The 2017 legislative and regulatory fronts were filled with activity that affects U.S. businesses in a big way.  Needless to say, plenty of that activity particularly affects the hard-working businesses within our own industry.  We each deal with issues in our own states, and I hope that you are as lucky enough to have an active and effective state association advocating strongly on your behalf.  On the national scene, big changes are always taking place, whether it is coming from the EPA, the IRS, or the US legislature-to mention a few.  We don't have the time, as we run our businesses, to keep up with and stay on top of these changes on a regular basis.  A regular update, I believe, will help all of us stay on top of the ever-changing political environment as it pertains to your business and our industry.  Besides the massive tax law of 2017, which we are all aware of and are actively investigating, I'd like to outline just a few of the laundry list of items that affected and is affecting you or our industry directly in 2017 and 2018. 
 
A 2-phase regulation, coming from the EPA-the last phase of which had become effective as of January 1, 2018-is the sale, purchase and/or handling of refrigerants, including R134a.  First off, you are exempt from these new regulations if and only if your business does not sell refrigerants or if your business sells MVAC (motor vehicle air conditioning) in small cans with the following attributes: 1) the cans must each be 2 pounds or less; 2) the cans must be equipped with a self-sealing valve.  If you are selling MVAC fluids that fit within those parameters, the EPA will leave you alone and you don't need to be concerned with the more restrictive components of this regulation.  If you are selling refrigerants outside of those parameters, these regulations pertain to you and they require that you only sell to technicians certified under Sections 608 or 609 under the Clean Air Act.  If you sell any refrigerants, it is important you read further in to the EPA's brief on the implementations and their requirements, especially if you are selling anything more than MVAC refrigerants in small cans.  For more information, visit http://bit.ly/2E0HP5Z and/or https://www.epa.gov/section608/refrigerant-sales-restriction, both from the EPA.

Another item of contention within the heavy truck industry is the EPA's proposal to repeal the emission standards and other requirements for glider vehicles, glider engines, and glider kits.  The current leadership of the EPA, led by Scott Pruitt, is pushing to remove glider kits from being considered as "new motor vehicles", "new motor vehicle engines" and "incomplete" new motor vehicles.  If repealed, the EPA would not have authority to regulate glider kits per the Clean Air Act, like it does now.  The EPA requested comments from the public be submitted for review to be considered in the decision-making process.  The public comments were largely for keeping the rule as is.  The comment period closed early January and the EPA's decision is still pending.
 
The groups that sponsor the Mercury Switch/End of Life Program have agreed to renew the program through the year 2021.[i]  The Mercury switch program, since its inception in 2005, has collected over 6.7 million switches to date-that's about 7 tons of Mercury switches.  In 2017, the program collected over 200,000 switches, and is on track to do so again this year.[ii]  The program is convenient and cost-free to dismantlers and recyclers, and applies to most class 6-8 trucks.[iii]  Simply request a bucket, fill it up, then use pre-paid shipping labels to send in the buckets.  To enroll in and take advantage of cost-free the program, visit www.elvsolutions.org and hit "Program Enrollment."
 
Finally, noteworthy news coming from Wilmington, California.  In October of 2017, a California DMV strike team, whose sole purpose is to investigate companies illegally dismantling vehicles and selling used parts, cracked down on 36 locations suspected of illegally dismantling vehicles in Wilmington.  Every state is different in whether it requires a license of dismantlers, the extent of requirements to obtain said license, and the enforcement of those license laws.  California has one of the strictest dismantler license laws in the country, and the state actually enforces that license law on a regular basis.  24 individuals were cited with illegally dismantling, and a handful of others were cited with related violations.[iv] 
 
The Automotive Recyclers Association's legislative department, and CEO, Michael Wilson have agreed to partner with the ITPA in assisting us in our effort to watch, inform, and advocate for our membership on a legislative and regulatory front nationwide.  I'd like to thank the ARA for their willingness to partner with us in keeping a watchful eye.  As long as the ITPA board and members find this legislative watch and update activity useful and relevant, our legislative committee will continue to keep an eye on activity affecting the nation and individual states, as it pertains to our membership as a whole.

Edward "E.J." Utley  1935-2018

Utley, Edward E.J.of Orlando, passed away at home on Wednesday, January 24, 2018. He was 82 years old and the beloved husband of Jo Ann for 59 years. He was born November 11, 1935, in Owosso, Michigan, but lived most of his life in Orlando. He was the eldest of eight children. E.J. served his country with Honor and Distinction in the US Army in 1959 & 1960 and was named Outstanding Honor Graduate of his class in the 4th Training Regiment. He chose a career in the trucking and transportation industry, starting his first business, West Orange Trucking, in 1964, hauling road material for the builders of the missile pads at Cape Canaveral. In 1970, he and Jo Ann and two former partners, opened E.J. Sales & Service, Inc. which lasted for 38 years and closed in 2008 due to his health. His work ethic was second to none. E.J. loved car racing. He was a Stock Car racer in the 50's, drag racer in the 60's, and a "Big Rig" truck racer from 1982-1992, winning two Grand National Championships in 1984 and 1989. He received the 1st Doug LeRoux Memorial Trophy, presented to the person who best exemplified the spirit of good sportsmanship and dedication to the sport of professional truck racing. He won the 1st Big Rig race, Gran Premio of Mexico in 1986. E.J. was a man of immense knowledge, hardworking, loyal and with his warm smile and outgoing personality, he never met a stranger. He was predeceased by his parents, Highram and Josephine Utley; two brothers; and two sisters. He is survived by his wife of 59 years, Jo Ann Johnson Utley; sisters, Judy Utley and Eunice Engel; brother, Jerry Utley and many nieces, nephews and cousins. Funeral Services with Military Honors were held on Thursday, February 1, 2018. Special thanks to Jo Ann Moody, Sheryl Grantham, Ena Ulysse and the amazing people at Vitas Hospice Team # 1712, for their love, support and care shown to E.J.
